AbcConnect Internet Services Terms and Conditions of Service These Terms and Conditions govern the use of internet services provided by AbcConnect. By subscribing to our services, the customer agrees to comply with the following terms. 1. Service Description AbcConnect provides wireless internet connectivity services to residential and business customers. Service speeds and performance depend on the selected package, network capacity, and environmental conditions. While AbcConnect strives to maintain reliable connectivity, service availability may occasionally be affected by factors beyond our control. 2. Fees and Payment Customers are billed monthly according to the selected service plan. Payment terms: • Payment is due within 30 days of the billing date • Late or unpaid accounts may result in service suspension • Service may be restored once the outstanding balance has been settled AbcConnect reserves the right to adjust pricing with reasonable notice. 3. Service Availability AbcConnect strives to maintain a highly reliable network. However, service interruptions may occur due to: • Scheduled maintenance • Network upgrades • Equipment replacement • External infrastructure issues Where possible, customers will be notified in advance of planned maintenance. A detailed copy of these Terms and Conditions is available upon request. 4. Acceptable Use Policy (AUP) Customers agree to use the service responsibly and in accordance with all applicable laws. Prohibited activities include: • Illegal downloading or file sharing • Distribution of malware or harmful software • Attempting unauthorized access to networks or systems • Sending spam or unsolicited bulk messages • Activities that interfere with network stability or performance AbcConnect reserves the right to limit, suspend, or terminate services if these rules are violated. 5. Privacy Policy AbcConnect respects the privacy of its customers. Customer information is collected and used only for the purpose of: • Providing internet services • Account management and billing • Technical support • Network management and improvement Customer data will not be sold or shared with third parties, except where required by law. 6. Intellectual Property Customers are responsible for ensuring they have the necessary rights to transmit, access, or distribute content over the internet. AbcConnect will comply with lawful copyright or intellectual property claims where applicable. 7. Limitation of Liability To the fullest extent permitted by law, AbcConnect shall not be held liable for: • Service interruptions • Loss of data • Loss of business or income • Damages arising from the use or inability to use the service This includes interruptions caused by power failures, weather conditions, equipment failure, or third-party infrastructure issues. 8. Termination of Service AbcConnect reserves the right to suspend or terminate service if: • Payment obligations are not met • Terms of service are violated • Network abuse occurs • Illegal activity is detected Customers may cancel their service subject to applicable notice periods and equipment return requirements. 9. Customer Support Customer support is available during business hours through: • Phone • Email • Messaging platforms or support channels provided by AbcConnect AbcConnect will make reasonable efforts to resolve issues as quickly as possible. 10. Changes to Terms AbcConnect may update these Terms and Conditions from time to time. Customers will be notified where reasonably possible. Continued use of the service constitutes acceptance of any updated terms. 11. Governing Law These Terms and Conditions are governed by the laws of South Africa. Any disputes arising from this agreement will be resolved according to applicable South African law. 12. Equipment Ownership All installations valued below R2500 remain the property of AbcConnect and do not transfer ownership to the client. Customer Premises Equipment (CPE) such as: • Antennas • Routers • Mounting hardware • Network equipment may remain the property of AbcConnect. Upon cancellation of service, AbcConnect reserves the right to remove and recover company equipment. Customers are responsible for ensuring equipment remains safe and undamaged while installed on their premises. Damage due to negligence, tampering, theft, or misuse may result in repair or replacement charges. 13. Remote Router Access Disclaimer In order to provide technical support and troubleshooting, AbcConnect technicians may require remote access to a customer's router or network equipment. Customers may be required to agree to a Remote Access Disclaimer before remote access is granted. By granting remote access, the customer acknowledges that: • Configuration changes may be required to diagnose or resolve issues • AbcConnect technicians will perform such changes with reasonable care However: • AbcConnect cannot be held liable for configuration issues or service disruptions resulting from remote troubleshooting • AbcConnect is not responsible for issues caused by unauthorized changes, misuse, or illegal activities performed on the router or network after the support session If an issue cannot be resolved remotely, an on-site visit may be required, which may result in a standard call-out fee according to AbcConnect service rates. 14. Power Outages and External Infrastructure AbcConnect infrastructure relies on external utilities and upstream providers. Service interruptions may occur due to: • Load shedding or power outages • Utility failures • Upstream provider outages • Fiber or backhaul failures Although backup power solutions may be implemented at certain sites, AbcConnect cannot guarantee uninterrupted service during extended outages. 15. Weather and Environmental Conditions Wireless internet services may be affected by environmental conditions such as: • Severe storms • Lightning • Strong winds • Heavy rain • Physical damage to towers or equipment These conditions may temporarily degrade or interrupt service. AbcConnect will restore services as soon as it is safe and practical to do so. 16. Fair Usage Policy (FUP) AbcConnect operates a shared network environment to ensure fair access for all users. Customers must avoid excessive or abusive bandwidth usage that negatively impacts other users. AbcConnect reserves the right to: • Implement bandwidth management • Temporarily limit speeds • Take necessary action to maintain network stability 17. Miscellaneous These Terms and Conditions constitute the entire agreement between AbcConnect and the customer. Failure by AbcConnect to enforce any provision of this agreement does not constitute a waiver of that provision.
